An illustrative example is the case of Iraqi national Mohammed al-Dhufairi. In 2022, he came to Lower Saxony and applied for asylum there. Three days later, he committed a violent offense. The Federal Office for Migration and Refugees (BAMF) ordered his transfer to Lithuania, where he had first applied for asylum.

Al-Dhufairi challenged the decision, as a result of which the proceedings dragged on for two years. During this time, he came to the attention of the police for stalking and exhibitionist acts. In 2025, the decision on his transfer finally became legally binding. In July, Al-Dhufairi was even supposed to be taken into deportation custody, but ultimately remained at large.

In August, the man allegedly pushed 16-year-old Liana K. in front of a train. She died at the scene. Al-Dhufairi was initially released again, as he was being treated merely as a witness and, according to the state of the investigation at the time, there were no grounds for detention. After traces of the man’s DNA were found on the deceased’s clothing, the Göttingen Regional Court determined that he lacked criminal responsibility and ordered his indefinite placement in a psychiatric hospital.

The defense filed an appeal on points of law with Germany’s Federal Court. Conclusion: The judgment did not become legally binding, and all possible deadlines for deportation have expired.
