Урок 1. Главное различие: topic ≠ research question ≠ thesis
Это первое, что нам нужно довести почти до автоматизма. Представьте три уровня.
Topic: The enforcement of arbitration agreements under English law.
Это всего лишь тема. Статьи здесь ещё нет.
Research question: Has the English courts’ increasingly pro-arbitration approach produced a coherent test for determining the scope of arbitration agreements?
Уже появляется проблема.
Thesis:
This article argues that the English courts’ ostensibly pro-arbitration approach has not produced a coherent doctrine of scope. Rather, recent decisions reveal two competing conceptions of contractual interpretation, which the courts have yet to reconcile.
Вот это уже начало академической статьи.
Обратите внимание на конструкцию: This article argues that X, because Y, and therefore Z.
Не обязательно буквально писать именно так. Но автор должен уметь закончить фразу: My argument is that...одним-двумя предложениями.
Если не может, статья пока не существует.
Что отличает сильную английскую статью
Практикующий юрист обычно мыслит так: What is the law?
А академический автор добавляет ещё четыре вопроса:
What is wrong or unexplained about the existing account of the law?
Why does that matter?
What have courts and scholars said about it?
What am I adding that they have not already said?
Поэтому предложение вроде: This article examines recent developments in English law concerning... обычно слабое. Оно сообщает тему, но не argument.
Сильнее:
This article challenges the prevailing view that...
или:
This article argues that the Court of Appeal's reasoning in X rests on a distinction that cannot be sustained doctrinally.
или:
Existing commentary treats X and Y as separate doctrinal problems. This article argues that they are manifestations of the same underlying difficulty.
Вот здесь уже чувствуется Cambridge/KCL-style scholarship: автор вмешивается в существующий разговор, а не пересказывает право.
Формула, которую я хочу вам поставить
Для doctrinal legal article будем использовать:
Problem → Existing explanation → Defect → New claim → Consequence
Например: English courts do X.
Scholars generally explain X through Y. But Y cannot explain cases A and B. I argue that Z provides a better account. This changes how we should understand/apply/reform the doctrine.
Это скелет очень большого числа сильных юридических статей.
И ещё одно важное различие.
Нам не нужна искусственная "academic language". В хорошей английской legal scholarship ценится ясность. Oxford прямо выделяет clear and scholarly style, well-structured argument и good judgment.
То есть мы будем избегать такого: It is humbly submitted that the aforesaid jurisprudential developments demonstrate a multifaceted and somewhat problematic conceptual paradigm...
И стремиться к: The distinction is difficult to defend.
Коротко. Точно. Проверяемо.

Назовите одну конкретную проблему английского коммерческого права или международного арбитража, о которой вам действительно хотелось бы написать статью.
Пока только тему, одним предложением. Я не буду придумывать research question за вас: следующим шагом мы вместе превратим вашу тему в вопрос уровня хорошего UK law journal.
