MK: Then there are highlights reported on via CBS News from her voluntary statement to police, and these two, I mean, are just very telling. The first and foremost is she reiterates that she was excited about her initial threesome with Matt and John. That's her word. It's in quotes. "I remember being excited."... Then she goes on to say that thing that we talked about: "wanting to have a threesome meant that they were gay, which would have meant that they were part of my community, as I am bisexual." Okay, whatever. She does in this statement to the police tell them that she had been drinking Tito's vodka, had consumed approximately six shots before someone took the bottle from her. She claims to have consumed several sips from another sorority sister's mixed drinks, and that when she went to a bar, she claims she got a sex on the beach mixed drink. The bar has denied that, but that's her claim. So we're seeing where she got drunk. None of that is suggesting that somebody else got her drunk. She made the choices. That's what's damning to her sexual assault claims, the criminal ones, potentially not the civil, though it should be civil too. In any event, then she she says she's talking about the moment she was hit by defendant number two. "I began to feel blank hit me many times on my butt. I remember that they were hurting me, and one in particular sent a sharp pain through me many times on my butt. I remember that the hits were hurting me... And I said, 'Damn!' One sent a sharp pain through me, which caused me to turn around and say, 'Damn!'" Now this is unpleasant and I understand the discomfort. However, the ability to remember these things in intimate detail is just fatal to her claim. She is not physically incapacitated. That's the legal standard. If she can prove she was physically helpless. They can bring charges. Her recitation from the beginning to now proves anything but proves she remembers everything in great detail. On some things she may be fuzzy, but overall she can remember the play-by-play and told it to police.
