Living abroad does not strip a parent of protection over their home in India. The Bombay High Court has ruled that an OCI cardholder can seek relief under the Senior Citizens Act even without Indian citizenship or being over 60, drawing a clear distinction between a “parent” and a “senior citizen” under the law. In a dispute over a Juhu flat, however, the court also recognised the daughter-in-law’s claim that it was her shared matrimonial home, so it refused to evict her while guaranteeing the owner and her family unrestricted access and peaceful residence. The ruling draws a careful line: protecting parents does not automatically erase the housing rights of other family members.
