🔻 BREAKING: THEY’RE NOT JUST TRYING TO PROTECT THE SUPREME COURT. THEY’RE TRYING TO LOCK THE NUMBER NINE INTO THE CONSTITUTION.
Speaker Mike Johnson says Republicans are moving to stop future attempts to pack the Supreme Court. But almost everyone reading that headline is missing the detail that makes this different.
The Supreme Court has nine Justices today. The Constitution does NOT require nine. The number is established by federal law, meaning Congress can theoretically change the size of the Court through legislation — exactly what happened multiple times throughout American history.
H.J. Res. 1 changes the equation. The proposed constitutional amendment contains one remarkably simple command: the Supreme Court of the United States shall be composed of nine Justices. One Chief Justice. Eight Associate Justices. No 11. No 13. No political majority adding seats when it doesn’t like the Court it inherited.
And look at the timing. The House Judiciary Committee already advanced the proposal 15–8. It moved onto the House Calendar. Now Johnson says leadership is bringing the fight to the floor and forcing Congress to put its position on record.
But here’s what the headline won’t explain: passing Congress would only open the next gate. A constitutional amendment requires two-thirds of both chambers, followed by ratification from three-fourths of the states — 38 states. The current proposal gives them seven years.

Nine Justices.
Two-thirds of Congress.
Thirty-eight states.
Seven years.
Don’t mistake that for an official code. It’s simply the architecture sitting in plain sight.
Why go through the enormous difficulty of changing the Constitution when nine Justices already sit on the Court?
Because a statute protects the number today.
A constitutional amendment would attempt to protect it from tomorrow.
And remember what else just happened: the Supreme Court has been sitting at the center of some of the biggest fights over presidential authority, elections, federal power and the limits of Washington. Meanwhile, arguments over expanding or restructuring the Court haven’t disappeared.
So watch carefully.
They aren’t debating who occupies Seat 10. They’re fighting over whether Seat 10 can ever exist.
Most people will watch the vote.
Pool watches what they are trying to make permanent.

The signal is getting louder.
