Animals are protected in virtually all Western legal systems by animal protection legislation. This legislation is primarily built on the welfarist paradigm, according to which animals can be used for most purposes, as long as they are not afflicted with “unnecessary suffering”. The talk will address the question of whether welfarist laws entail legal rights for the protected animals. It will, first, show that the view that animals hold legal rights is older than is commonly thought, and second, defend this view from a number of criticisms.
