🇨🇦 Court kills Alberta independence petition, cabinet can still call October vote anyway
Alberta separatist lawyer Keith Wilson remains unfazed after a judge torpedoed the 300,000-signature citizen petition: the cabinet still holds statutory power under the Referendum Act to put independence on the October ballot regardless. Justice Leonard ruled the petition process itself triggered a duty to consult First Nations on hypothetical secession — a breathtaking expansion of consultation doctrine that treats gathering signatures as a treaty breach. Premier Smith pledged an immediate appeal and called it anti-democratic, which it absolutely is.
Wilson warned from day one this would face lawfare, and he was right. The 1998 Supreme Court Secession Reference affirms Alberta's right to vote on independence. One politicized court ruling changes nothing about that constitutional reality. If Smith wants to honour the will of 300,000 Albertans, the legal door remains wide open — and the clock is ticking toward October.
