Continued reporting on the trial of Ukrainian political prisoners Alexander and Mikhail Kononovich.

The brothers were not brought to the court session. They can watch how their case is solved only on video.

1. On July 5, 2022, the court will announce the decision to extend the arrest for the brothers - communists.

The anti-fascist Kononovich brothers were arrested by the Security Service of Ukraine and Nazi formations on March 3, 2022 and spent several days in an unknown place where they were tortured until the brothers were brought to a pre-trial detention center.

In the draft court decision: to extend the arrest for 66 days (Ukrainian law allows to extend the arrest only for 60 days).

The draft states that the brothers Kononovich can get out of prison, subject to the payment of a bail of 190 thousand hryvnia for each.

What exactly will be the decision of the court - we will see on July 5.

2. The Security Service of Ukraine (SBU) accuses Oleksandr and Mykhailo Kononovich under Part 1 of Article 109 of the Criminal Code of Ukraine (“actions aimed at forcibly changing the political system or seizing state power”).

They face 10 years in prison.

3. If the court releases the brothers from custody on bail, the SBU will immediately arrest them again on charges under part 2 of article 109 of the Criminal Code of Ukraine (“public calls for the seizure of state power”) or part 3 of article 109 (“capture state power by an organized group").

This practice of re-arresting people released by a court is common in Ukraine.

The "organized group", according to the SBU, consists of only two Kononovich brothers.

The SBU does not name anyone else who could be a member of the "organized group" to seize power in Ukraine.

4. The case against the Kononovich brothers was opened on February 1, 2022, that is, before the outbreak of hostilities on February 24.

5. The SBU claims that the Kononovich brothers planned to seize one of the district administrations.

However, the SBU did not establish which administration the brothers were going to seize.

Also, the SBU did not establish either the time or the circumstances of the "capture".

6. Also, the SBU, as evidence of the "crimes" of the brothers Kononovich, cites their publications on the social network Facebook.

In these publications, the brothers criticize the current Kyiv authorities.

Criticism of the government is guaranteed by the current Constitution of Ukraine.

The "examination" conducted by the institute, which is part of the SBU, also showed that the publications of the Kononovich brothers did not violate the legislation of Ukraine.

7. The SBU states that while at large, the Kononovich brothers "may commit crimes."

Millions of Ukrainians still at large, or tens of thousands of arrested Ukrainians, can also commit "crimes".

They can commit "crimes" when they think and say that the criminal anti-Ukrainian regime in Kyiv must fall.

On July 5, 2022, the court will announce the decision to continue the arrest.

On July 6, the court session on the charges of the brothers Kononovich in "actions to seize state power" will continue.
