Prime Minister Benjamin Netanyahu will begin testifying in his criminal trial on December 2, his judges decided on Tuesday.
This is less of a delay than Netanyahu's lawyer, Amit Hadad, had wanted. He had asked the judges to start the defense testimony only in March 2025, due to the war and the scope of the evidence.
By law, Netanyahu must be the first defense witness, since he is the primary defendant. He will therefore begin testifying more than four years after the trial began in May 2020.
"The point of departure for this discussion is that this is an unusually large and complex case," Judges Rivka Friedman-Feldman, Moshe Bar-Am and Oded Shaham wrote in their ruling. "At the same time, there is a substantial public interest in moving the proceedings forward as quickly as possible. This interest also coincides with the interest cited by most of the defendants – preventing a delay of justice."
The judges said they had considered Hadad's arguments, including the fact that Netanyahu's original defense attorney in one of the three cases against him, Boaz Ben Zur, has asked to withdraw once the defense testimony begins and will therefore have to be replaced, as well as the fact that he would need to prepare for his testimony in the midst of running a war. Nevertheless, they wrote, they "also took into account the length of time the defense has had until now to prepare for these hearings."
