Does alleged harm come out of the infiltration itself? Or Publication? The ‘harm’ is out of the publication, and therefore it is protected by the 1st amendment..

ISSUE 2; Is there a fiduciary duty to the organization you are investigating? Can an intern who was part-time who was unpaid and who did not sign an NDA – can a fiduciary duty be hoisted on them unilaterally??
