Kashane Daley walked into a Toronto Tim Hortons in 2018, grabbed a random 16-year-old in a headlock, and repeatedly stabbed him in the neck, chest, and arm. The kid needed surgery for lacerations to his liver and diaphragm. Eight days in hospital. Daley stole his iPad, fled, and left his wallet at the scene like a criminal parody. Now he's been granted an absolute discharge — no supervision, no conditions, free to go. Not criminally responsible, they said. Schizophrenia, they said.
Daley immigrated from Jamaica at nine or ten, diagnosed with learning disabilities, expelled repeatedly, and had a criminal record before this attack. But the Ontario Review Board, the hospital, and the Crown all agreed: not a threat. Meanwhile the victim carries scars for life and the public gets another lesson in how our justice system prioritizes the accused over the innocent. This is what broken borders and broken institutions look like when mixed together.
