When you look at how the prohibited hate group laws are structured, with the pheonixing provision that Tony Burke can ban anything he “reasonably believes” is a “continuation” at the stroke of a pen, even if it contains as little as one former member.
It’s clear that part of this legislation, proudly contributed to by ECAJ, attempts to ban certain individuals from ever coming together to collectively political organise.
Anything Thomas, Jacob, Joel, myself, etc. did in future, even if completely different ideologically and aesthetically, will be captured under this “phoenixing” mechanism, which was confirmed as a possible situation in the High Court when probed at by the bench.
This in practice functions as a political exiling on the individuals that made up NSN and WAP, from ever coming together in future again.
