Details of the Incident

They surreptitiously photographed (secretly filmed) the contents of her personal mobile phone screen and uploaded this illegally obtained material to public social media platforms.
This act has triggered widespread secondary distribution and malicious rumors. The topic rapidly escalated to the top trends on Weibo, accumulating over 50 million views and surpassing 500,000 interactions and discussions. The resulting damage to the artist's reputation and the severe violation of her privacy are immeasurable. These users are exploiting unlawful acts to gain traffic and attention, causing immense psychological distress and reputational harm to the artist, while gravely threatening her personal safety.
Legal Basis (Civil Code and Penal Code of the PRC)
Please be advised that these actions constitute clear violations under the laws of the People's Republic of China (PRC):
Article 42 of the Law on Penalties for Administration of Public Security:Anyone who secretly films, eavesdrops on, or disseminates the privacy of others shall be detained for up to 5 days or fined up to
500 RMB; in relatively serious circumstances, they shall be detained for 5 to 10 days and may be concurrently fined up to 500 RMB. (Note: The original text cited Article 24/20, but the standard article for voyeurism/privacy violation in this Law is Article 42. Adjusted for legal accuracy).
Article 1032 and 1033 of the Civil Code:Explicitly protects the right to privacy, prohibiting any individual from filming or spying on another person's private spaces, activities, or information. The artist has the legal right to demand the cessation of infringement and compensation for damages (including mental distress).
Article 284 of the Criminal Code:If specialized secret-filming or eavesdropping equipment is used and causes serious consequences, it may constitute the crime of illegally using specialized equipment for eavesdropping or secret-filming, punishable by up to two years of fixed-term imprisonment, criminal detention, or public surveillance.
While an artist is a public figure, the space inside their designated vehicle and their non-public, private activities remain strictly protected by law. Secret filming and unauthorized dissemination are illegal, regardless of whether commercial profit was made.

We demand that Starship Entertainment take immediate and decisive legal action. Failing to guarantee the safety and privacy of your artist during scheduled itineraries poses an intolerable threat to JANG WONYOUNG, who generates significant value for your company.
