Europe's MiCA transition period is coming to an end. This marks a turning point for the European crypto market, and the end of the road for some players.
❗️ From this date, any company providing crypto services to EU clients without a CASP license will be breaking the law. No country has the right to extend the deadline. On June 23, ESMA issued a clear statement: unlicensed providers must stop onboarding new clients, stop marketing their services, and only process withdrawals and close positions.
According to industry estimates, up to 80% of the exchanges currently operating in Europe could leave the market.
But it's important to understand who this deadline actually affects. MiCA regulates crypto-asset service providers, exchanges, custodians, and brokers.
🤩 Crowdlending is structured differently, and that's how 8lends is built.
🔘 The platform doesn't rely on a single legal entity. Instead, each role is handled by a separate company. Operations are managed by CLEARCHAIN CORP, a company registered as a Money Services Business with FINTRAC (Canada). This registration explicitly covers crowdfunding and virtual currency transactions.
This status was obtained in advance and remains valid until August 2028. While the market is still assessing the impact of July 1, the platform's legal framework has already been established and confirmed for the next two years. Its operations are covered by a specialized license within its own regulatory category, not a CASP license. This means the deadline doesn't change the legal basis on which the platform operates.
🔘 The software is owned by another company, Alpha Systems LLC. It provides the code, interfaces, and integrations, and nothing more. It's not a lender, a settlement provider, or a trading platform.
Each legal entity is responsible for its own role and operates within the scope of its legal status.
🇪🇺 What does this mean for EU investors?
Nothing changes. July 1 does not introduce any re-registration requirements, restrictions, or operational changes for existing clients. The platform continues to work as usual. Access for EU users who joined the platform voluntarily remains available under Article 61 of MiCA, subject to standard KYC/KYB and AML procedures.
🤔 What should we expect next?
As the product line expands, some future products will go beyond the current scope of 8lends and require a CASP license. So, we're planning to obtain a MiCA license for new products when they appear, not retroactively for the existing ones.
👍 MiCA cleans up the crypto space.
July 1 neither creates nor destroys anything. It reveals who has been building the infrastructure all these years, and who's got nothing underneath.
This is just an overview post, so it doesn't cover every aspect of the MiCA discussion.
