During the Biden Administration, Title IX was changed. They made the right to cross examine an accuser in a Title IX hearing optional, at the option of the accuser. They tried to abolish it completely, but the courts said no to that.
On September 28, 2026, the Trump administration's Department of Education formally published a rule removing Biden-era regulations from the Code of Federal Regulations about Title Ix hearings.
By repealing the changes, the current DoE officially restored the 2020 framework, which reinstates mandatory live hearings and advisor led cross examinations for sexual misconduct allegations at all universities and colleges.
