Senator Cory Booker introduced an amendment during last week's farm bill markup that would have restored cancer victims' right to sue pesticide manufacturers in state court. The amendment failed.

Booker's amendment responded to a June Supreme Court ruling that gave Bayer a liability shield, holding that EPA label approval grants pesticide manufacturers permanent immunity from failure-to-warn lawsuits.

His amendment would have clarified that federal pesticide law, known as FIFRA, does not block those state court claims, and would have explicitly authorized companies to add cancer warnings to pesticide labels.

Booker connected the vote to April 27th's People vs. Poison rally at the Supreme Court, where farmers, farm workers, doctors, and cancer survivors gathered to oppose the case.

He told colleagues who claim to support the MAHA movement that they could not claim to want to make America healthy again while voting to protect corporate profits over cancer victims.
